Welcome to Living Garments. These Terms of Service (“Terms”) govern your use of livinggarments.shop (the “Site”) and your purchases from Living Garments LLC (“Living Garments,” “we,” “us”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Using the Site

You must be at least 18 years old to place an order. You agree to give us accurate information, to use the Site only for lawful purposes, and not to interfere with the Site or its security, scrape or copy it in bulk, or attempt to access anything you are not authorized to access.

2. Products

We do our best to show our products accurately, but colors and details may look different on your screen. We may limit quantities, discontinue products, or correct errors in descriptions or pricing at any time.

3. Pricing, Payment, and Orders

Prices are in U.S. dollars unless stated otherwise. Taxes and shipping are calculated at checkout. Payments are processed securely by our payment processors, and we do not store your full card number. An order is not final until we accept it. We may cancel or refuse an order, for example if a product is unavailable, there is a pricing error, or we suspect fraud. If we cancel an order you already paid for, we will refund you.

4. Shipping and Delivery

Delivery dates are estimates, not guarantees. Delays can happen because of carriers, weather, or other events outside our control. Please make sure your shipping address is correct, because we are not responsible for orders delayed or lost due to an incorrect address.

5. Returns and Refunds

Our Refund Policy explains how returns and refunds work and is part of these Terms.

6. Your Account

If you create an account, you are responsible for keeping your login details secure and for activity under your account. Tell us right away if you think someone has used it without permission.

7. Our Intellectual Property

The Site and everything on it, including our name, logo, designs, graphics, photos, and written content, belongs to Living Garments or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use any of it for commercial purposes without our written permission.

8. Reviews and Content You Submit

If you post a review, photo, or other content on or send it to us, you confirm that it is yours to share and that it is truthful and lawful. You give us a non-exclusive, royalty-free license to use, display, and reproduce it in connection with our business, including on our Site and social media. We may remove content that is unlawful, abusive, or misleading.

9. Third-Party Services and Links

The Site may link to or rely on third-party services (for example, payment processors and shipping carriers). We do not control them and are not responsible for their content, policies, or practices.

10. Text Message (SMS) Terms

Program. Living Garments LLC sends recurring automated text messages to people who opt in. These may include offers and promotions, abandoned cart reminders, requests for reviews, and order and account updates.

How you opt in. You consent by checking the text message opt-in box at checkout or by signing up through a form or subscription tool that links to these terms. Placing an order does not sign you up for marketing texts. Consent is not a condition of any purchase.

Frequency and costs. Message frequency varies. Message and data rates may apply. We do not charge for texts, but your wireless carrier may.

How to opt out. Reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to any text, use the unsubscribe link in a message, or email support@livinggarments.shop. We will honor any reasonable request that clearly tells us you do not want more texts. After you opt out, we may send one text confirming it.

Help. Reply HELP to any text or email support@livinggarments.shop.

Carriers and delivery. Carriers are not liable for delayed or undelivered messages. To the extent permitted by law, we are not liable for failed, delayed, or misdirected messages.

Your information. We do not share your mobile number or text opt-in information with third parties or affiliates for their own marketing. See our Privacy Policy for how we collect and use your information.

11. Disclaimers

To the extent permitted by law, the Site is provided “as is” and “as available,” and we do not promise that it will always be uninterrupted or error-free.

12. Limitation of Liability

To the extent permitted by law, Living Garments is not liable for indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim is limited to the amount you paid for the order at issue. Nothing in these Terms limits any rights you have under applicable law that cannot be waived.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. If we have a dispute, please email us first at support@livinggarments.shop so we can try to resolve it. If we cannot, the dispute will be handled in the state or federal courts located in Colorado.

14. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above shows the most recent version. Continuing to use the Site after changes means you accept them.
